Your access to and use of the services offered by Dr de Villiers of Health Function Ltd (the “Service”) is conditioned on your acceptance of and compliance with these Terms. You warrant that you are at least 16 years old and legally capable of entering into binding contracts. Where a patient is under 16, a parent or guardian enters into these Terms on their behalf and is responsible for payment.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Health Function reserves the right to decline an application for service.
Payments and refunds
- Fees are listed in the Fees section of the website.
- Fees include GST and are in New Zealand dollars.
- A one-off registration fee is charged when an application is accepted.
- Registration is for a year. Subscriptions are paid monthly in advance.
- The first month is paid before any clinical work begins.
- Payment is by credit or debit card through Stripe. Bank transfers are not accepted.
- Monthly fees are debited automatically from the card held by Stripe on the same date each month. Health Function does not hold card details.
- Where a payment fails, the card can be updated from the patient’s Health Function account (opens in Stripe). If it is not updated within two weeks, the subscription is cancelled.
- Fees may change at the start of a new subscription year. Fees do not change during a subscription year.
- Consultations included in a subscription are used within that subscription year and do not carry over to the next.
- Additional services, including consultations beyond those a subscription includes, are payable in advance.
- Fees are non-refundable.
- Health Function may refund an amount, or adjust, suspend or cancel future payments, where it is required to do so by law. If required to refund any amount to you, the clinic will pay that amount to your nominated card or, at our option, adjust, suspend or cancel future payments to offset the amount due to you.
Cancellation
- Registration is for a year, and a subscription may be cancelled at any time from the patient’s Health Function account (opens in Stripe).
- Where a subscription is cancelled during a subscription year, billing stops at the end of the month already paid for. Fees already paid are not refunded and consultations not used are not carried over.
- On cancellation, or at the end of a subscription, clinical notes can be sent securely to a preferred provider on request.
Emergency and after-hours care
Health Function provides ongoing planned care for registered patients, and is not an emergency or after-hours service. Dr de Villiers is the primary care provider for some patients and works alongside an enrolled GP for others. Staying enrolled with a general practice is encouraged but not required. Complementary and alternative medicine
Your consultations may include standard medical treatment alongside complementary and alternative medicine, including nutritional, nutraceutical and herbal therapies, and the investigation and treatment of environmental factors. This may differ from current medical guidelines and may not be scientifically validated. For further information refer to the Medical Council of New Zealand’s statement on complementary and alternative medicine.
Governing law
These Terms are governed by the laws of New Zealand.
These Terms, together with the Rights, Privacy and Consent to Treatment policy, form the agreement between you and Health Function Ltd about your subscription, and replace any earlier terms of trade. If any part of these Terms is held to be invalid or unenforceable, the rest remains in effect. A failure to enforce a provision is not a waiver of it.
Changes
These Terms may be updated from time to time. Where a change affects a current subscription, registered patients are notified by email before it takes effect, and fees do not change during a subscription year. The date at the top of this page shows when the Terms were last updated.
